For Use of Images

we review your request for permission for usage and licensing
and will depend upon the graphics you are interested in licensing

These require custom design
Resale of images incorporated
onto greeting cards, t-shirts, and mugs,
etc. is not part of my terms of usage. Additional permission and
licensing
is required for images planned for use on resale products, and these
images must be custom-designed for your particular product
At no time do the copyrights or ownership of
images transfer.
Exclusive use on a project is granted only to those contracting a custom design
and
with the approriate fees,but remain owned and copyrighted by eyecandee.com
all other images remain available for licensing by others
Unknown Third Party Copyrights in Derivative Artwork-->
images are not to be used or altered in a way except for cropping or resizing
Prior to using our images, we
require a hard copy of the publication or sample of
product be sent free of charge for our review and approval for intended use
The applicant agrees to send one copy, best
edition, of the work containing the reproduction
at no charge. All expenses for shipping and handling are the responsibility
of the applicant
Fees for usage - permissions for use must be approved prior to licensing fees
These rates are for general info only. Specifics for combination
of usage and further details of print runs or uses not mentioned below are
available when we receive an application for licensing
Prices are quoted per image used, per single
use unless noted below
These prices are for approved single usage only -
approval for usage will be determined when a request is received
All images must bear our copyright info in a
visible area on the graphic, and a copyright
statement posted in the appropriate area of publications detailing the source of
the imagery
Electronic users must cite the creator and
source of this material as they
would material from any printed work; the citation should include our
link
The payment of a commercial use fee does not exempt the user from the credit
requirement.
Failure to include a credit or electronic water mark, or inaccurate captions or
credits
shall require the applicant to pay the sum of One Hundred Dollars ($100) per
image
Licensing for additional uses over single (one time or one project) use carries additional fees
Image Usage and Rights Requests
Procedure
All requests for permission to reproduce images must be submitted
in writing and should include the
following information: description of desired image, description of proposed
use (nature of the publication, print run, publication date, title, author, and
location of the image within the publication). Permission for such use is
granted on a case-by-case basis and at the sole discretion of the creator. For
all other requests, please provide as much detailed information as possible
concerning the image and the proposed use.

Other Information on Rates
Permissions and fees for custom created images for use in
publishing other items for sale are separate and detailed by request or within
the specialty pages of this website (cards, giftwrap, wallpaper, fabric runs,
etc.)
Please note that the cost of designing a graphic or graphics collection is not
included in the usage fee. Use is not permitted for book or magazine covers
except for custom design, and clearance for all editions will be higher than the
rates shown
Discounts are given for quantity use (10 or more images) and further details are available upon application. Please note that the rates listed for books and specialist journals are for print runs of up to 5,000 copies only - additional fees are charged over that amount of copies.

In the case of
derivative/vintage artwork used in the graphics collections containing an
unknown
copyright still in effect, the user must seek permission from the creator of the
work or his/her heirs.
We will provide the creator's name, if known. We provide licensing for use of
the finished graphic
and our enhanced artwork collections, but you are responsible for permissions
for use if any
copyrights might still be in effect. Images used were listed as public domain,
purchased as
permission free, or with expired copyrights, but it's best to be sure before
using them.
In instances where the individual or organization who may grant permission cannot be contacted, the we may consider granting permission for reproduction based on the applicant's evidence of a good faith effort to contact the appropriate individual. However, we assume no responsibility for infraction of copyright laws, invasion of privacy, or any other improper or illegal use that may arise from reproduction of any image.
In all instances, the applicant agrees to hold eye candy and its agents harmless against any and all claims arising or resulting from the use of the material and shall indemnify An Eye For Design and its agents for any and all costs and damages arising or resulting from any such unauthorized use.
